ATB CLASSIC CAR RESTORATIONS

STANDARD TERMS OF AGREEMENT AND CONDITIONS OF SALE

1. DEFINITIONS

1.1 Goods means any mechanical component or fabricated part supplied by ATB CLASSIC CAR RESTORATIONS

2.BASIS OF CONTRACT

2.1 An order from a customer shall constitute an offer
2.2 An invoice or written confirmation of order from ATB CLASSIC CAR RESTORATIONS constitutes an acceptance
2.3 All contracts are subject to these written terms. Any variations to the terms or representations regarding the goods are not binding unless confirmed in writing by ATB CLASSIC CAR RESTORATIONS
2.4 The price of the goods shell be the ATB CLASSIC CAR RESTORATIONS current retail price which may differ from the published price, the customer should check with ATB CLASSIC CAR RESTORATIONS
2.5 An order accepted as above cannot be cancelled by the customer.

3.PAYMENT

3.1 Payment to be made in cash or cheque
3.2 A 50% non refundable deposit may be required for special order items
3.3 ATB CLASSIC CAR RESTORATIONS reserve the right not to dispatch goods until payments have been cleared

4.DELIVERY

4.1 Delivery charges will be shown on the final invoice
4.2 Any dates quoted for delivery of good are approximate only and are not part of the contract
4.3 We aim to deliver within 7 days. If an item is out of stock we will contact you immediately to arrange an alternative date or a refund

5. RETURNS

5.1 Goods are not supplied on a sale or return basis
5.2 Returns will only be accepted if previously agreed in writing by ATB CLASSIC CAR RESTORATIONS where the part ordered by the customer is supplied, but not the one the customer really requires, then ATB CLASSIC CAR RESTORATIONS may agree to exchange it but there will be a handling charge of 15%. ATB CLASSIC CAR RESTORATIONS may waive the handling change where replacement goods are of the same or greater price than the returned goods and where the returned goods are received back by ATB CLASSIC CAR RESTORATIONS intact and undamaged, within 30 days of original recipes by the customer
5.3 Replacement goods must be paid for in advance as set out in 3 above

6.TITLE TO THE GOODS

6.1 Risk passes to the customer on delivery
6.2 Title only passes to the customer on payment
6.3 Until payment the customer holds the goods as agent and bailee only, must store the goods properly, return them to ATB CLASSIC CAR RESTORATIONS if requested and pay to ATB CLASSIC CAR RESTORATIONS ANY MONEYS RECEIVED FOR THE GOODS

7.LIABILITY

7.1 ATB CLASSIC CAR RESTORATIONS are not liable for the consequences of incorrect fitting or use of good supplied
7.2 ATB CLASSIC CAR RESTORATIONS are not liable to the customer by reason of any delay of failure to perform arising from circumstances beyond the control of ATB CLASSIC CAR RESTORATIONS
7.3 ATB CLASSIC CAR RESTORATIONS are not liable for the problems for damages arising from failure by the customer to supply full or correct information.

8.LOSS IN TRANSIT

8.1 If the goods do not arrive within a reasonable time, the customer should report to ATB CLASSIC CAR RESTORATIONS who reserve the right to investigate before despatching replacement parts
8.2 Urgently required parts if in stock despatched before investigations are complete must be paid for in addition by the customer as set out in 3 above. The customer will be reimbursed where ATB CLASSIC CAR RESTORATIONS succeed in settling loss with the carriers or third parties

9 GENERAL

9.1 There should be no alteration in these terms and conditions save as confirmed in writing by ATB CLASSIC CAR RESTORATIONS
9.2 If any of these terms and conditions is or becomes invalid, illegal or unenforceable in law, the remaining conditions shall not be affected
9.3 The law applicable to the Agreement is the law in England and Wales and the customer will submit to the jurisdiction of the English and Welsh courts.
